Need to change school! Appeal or EHCP?

I’m new here! My DS has recently been diagnosed with ADHD, Classic Autism & Dyspraxia. We moved house in September and my daughter has just been given a place at a school near our new house my son is in his original school. School have failed to recognise my sons needs since reception he is in year 2 now. We’ve had many meetings they always said they would bring in learn and support if needdd but that we had to watch and wait. After too much watching and waiting he has been diagnosed privately. School questioned his diagnosis and communication and trust is non existent now. We just want him out too! The new school has a nicer SEN a therapy dog and better ethos plus nearer to home (8 miles) do I try and appeal or try for an EHCP which School won’t support???? Anyone who has been down this route?

Have current school put in any support at all? You could definitely do a parent referral based on difficulties at home etc but it would be useful to have some input from school.

Why haven't you transferred to the other school yet?

Assuming that the nearer school is full, there's no point appealing for a place now as the infant class size restrictions will apply up to the end of July. It would be worth trying then - the distance would be a strong factor in your favour. Have you put your son on the waiting list?

I'd suggest you apply for an EHCP at the same time. It's a fairly long process, but in the early stages when you are applying for assessment all you have to prove is that your child has or may have SEN and that he may need help via an EHCP, and if the school has been failing to honour its promises to bring in support that will help your case. Thank you so much for your reply we declined the place at this moment for my daughter as I didn’t want to seperate them! Do you know if you can appeal to get into a school even though you don’t have any other children there??

Yes, you can, but if it's full and you want a place in Reception, Year 1 or Year 2 it's extremely difficult at the Infant Class Size restrictions apply.
