Ex wanting to take me to court over DD high school place

Hi,

DD is due to start high school on September 2026. Applications need to be in by October 31st.

We live in different LAs and have our DD 50/50 (no custody agreement in place). I have been told that the application needs to be completed by me as the child benefit and dd’s GP is registered to my address. Ex is not agreeing to this and is saying he wants to submit the application for a school near his house even though the LA have said the application must be completed by myself and if he also applies both applications will become void as he would be completing it using false information eg. Address.

we have gone to mediation and the mediatior suggested our DD being involved which would mean her speaking to someone about her preference. I do not feel comfortable with putting my DD through having to speak to someone and potentially having to choose between which school.

atm she is leaning towards 1 particularly school which is not in my LA but is still undecided as she has friends at both houses.

I have said that I will apply and ask our DD which school she would like putting as the 1st choice but he is still not agreeing and is now threatening court which I really don’t want DD being put through.

what happens now? Can I still apply without his consent as I am concerned the deadline is approaching?

if it goes to court and the application is already in will that be held against me?

Is your DD choice the one near his house? The schools in my area are massively over subscribed, no one putting it down who lives far away would likely get in.

Hi, yes it is but I have been informed by the LA that he is unable to apply using his address as DDs main residence is with me.

i must add as well that ex does no school runs and relies on his elderly unwell parents so I have concerns of DD having to walk to school alone or be in the house alone which she is very afraid of.
