have tried Uni Law clinics (wait list timed out: now closed for summer)
I have tried my CAB (no legal advice available locally, in City yes but 8wk wait)
I have tried to get 15m free with local lawyer but 'won't advise ongoing case'
I'm Divorcing. Minute of Agreement signed. Now need to do Divorce.
QUESTION:
if I do my own Simplified Divorce & it turns out that lawyer was negligent in Minute of Agreement arrangements, would I still have the same redress as if they had done the Simplified Divorce process (just submitting papers) for me?
(REason I am asking about potential 'redress' is
Signed Min Ag (via Lawyers) last Nov. (then sent to Registers etc)
Week before it was signed it was amended.
Pension provider wrote to lawyer to say: 'amend line 6 from 'when pension is in payment' as pension is already in payment. Lawyer sent me this as an attachment asking me to approve. I did (I should have paid more attention but my eldest young person was having a breakdown so I just thought it was minor & trusted lawyer to check all okay). I have since had reason to realise that not only has exH been drawing down his pension for nearly a year from the -as-yet-unsplit pot but also he may have taken out a lump sum. Pension Co can't tell me. Lawyers not responding to my emails - suggest I do Simplified Divorce & hand papers over to Pension Co myself (!). I think they think I won't pay them (I'm on advice & assistance so not a cash cow for them anyway) but also worried they know they should have checked marital assets at that point & didn't & may have screwed up (they have on a number of other things)?
I'm very worried about this so I'm hoping there is a lawyer out there who could answer the 'QUESTION' bit or even advise about the details underneath? Please?
