17 years ago i married in Scotland and H and i bought a house together. Joint deeds and mortgage.
In Oct 2016 I move with 2 DC's temporarily to England. DC 1 has SEN and we were struggling to get dx in home county. Next nearest was over border. They referred immediately and we get dx (or not!) on Mon.
It was agreed that once we had that we would probably return but would see how happy kids were in new system.
I have paid all costs at this end. H has paid all costs at Scottish end (modest mort). I have had no maintenance / £ re kids at all.
H now says if i dont confirm i am returning to Scotland on Mon afternoon he will divorce me in October. He wants the equity from the house (£10k each max?) for a deposit for a bedsit. There would not be enough for housing for kids and I (one about to be dx ASD and I am disabled too) But hes' not worried about that.
Do I have the right to return? Before Oct? After Oct?
If I return and he divorces me can he force the sale of the house?
