Buying out

I want to buy my husband out but he will refuse to leave until he gets the money he is owed. I have the funds to give him his share, can I go to a solicitor and get a written agreement to just send him the money then he will leave, I don’t want to wait for the process as living with him isn’t bearable.

You need to wait for the legal process otherwise he could be back for more-or could still refuse to move out. Until it’s all signed and legally closed, I think you’re a bit stuck 😢

If he’s abusive you can apply to the court for an occupation order to have him removed from the home whilst you live in it and go through the sale process.

Do not hand over any money before the legal stuff is done because until that is done he still is a legal owner and has rights over the house.

Presumably you are also divorcing? Equity split of the house and arrangements to buy the other out need to be covered as part of your divorce settlement - not least because whilst you say you have the money to buy him out, this money may well be considered marital money to which he’s entitled a share of in divorce anyway. You need a solicitor and to get the process started, and absolutely before doing anything with the house.
