We've been separated for 4 years and I'm filing for divorce using the form on the Scottish courts website (two years separation without consent)

I'm struggling with the wording of this bit. It's on the website but not on the form. I am really tired so I'm easily confused right now (thank you DC for the 3am wake up call) Does this mean I have to have lived at my address for 40 days before filing or that my ex has to have lived at his address for 40 days or both of us? We've both lived in Scotland our whole lives so that part of the residency requirements is met.

Thank you.

It’s you or your spouse have to have lived at the address before making the application. So, have you lived at your current address for 40 days or more? If so, that’s all you need.

Thank you. That's how I read it too but was concerned that I hadn't interpreted it correctly.

I've lived at my address for 3 years and he's lived at his current address for 2 weeks after moving from his previous home so I wasn't sure if I would need to wait to file.
