Child maintenance

My dh has got a letter to state the csm are going to take legal action for unpaid child maintenance. However Dss started a social work course at uni and he stopped the payment at the end of August. I have done a search that he doesn't need to pay beyond this date. He does directly support his son with giving him money to help put but this does go to his ex. Obviously the ex has reported this. Just checking that he shouldn't be paying any longer.

Does not go to his ex but direct to his son.

No he shouldn't. Cms obligation ends when child benefit ends. I would report to cms and hmrc that he's now at university so child benefit should stop. Cms is payable up to 20 if studying a levels, not above.
Encourage it direct to his son as he has been as he will need it

The CMS will most likely have been advised by the RP that the child is still in education, but as PP has said; uni does
not count.

He just needs to confirm the dates DC started and where he is attending.
