I want to get divorced, I know I need to do it but I feel sick and don't know where to start. After a weekend of silent treatment I feel defeated.
I am employed by my husbands company. I also have another part-time job. Does anyone know where I will stand with this if we divorce? I know I need to speak to a solicitor but I need to be able to pull myself together first.
Married 8 years and 2 kids.

As your thread is titled “Salary”, then from that angle, presuming you’re actually an employee of his company performing an actual required role and not just an “employee” on paper for tax dodging purposes, then you have the same employee rights as you would with any other employer and will retain these post-divorce. Your salary can’t be withheld or your position terminated without the same process taking place as if you were any other employee. You have the right to retain your employment until you (as I presume is your intention) find a new job to replace it.

In terms of what you might be entitled to from the business as part of the divorce settlement you’ll need specialist legal advice as it’s dependent on all kinds of things, including whether you’re also a director or shareholder, what assets the business has, its ownership structure, how it’s incorporated and so on.

Thank you. I am down as secretary. I do the accounts. I don't want anything from the business, I just want to keep my salary until o can up my hours at my other job. Obviously I don't want to continue working together, it's horrendous.
