Joint tenancy and separated living in the same house.

So I’ve had info from citizens advice that I can claim universal credit. I’m married however my husband and I are separated however we still live in the same house. ( Long Story he won’t leave) From what citizens advice have mentioned as long as we show we’re separated I can get help and for my kids. Is anybody else doing this or in the same predicament?

My MIL was in the same situation for years as FIL refused to move out. MIL did get some benefits

My advice is to seek support from
Women's aid
Or
Others to get him out, you have rights in this situation!

I'm sorry I'm not sure but I would have thought only once he leaves/forced to go as then I guess they'd perceive you as a single parent? Does the CSA website have any better information?

How long left on the tenancy?
Has he been abusive? If so you may be able to get an occupation order. If not, you'll have to ride out the tenancy.
If you are completely upfront with UC then you should be entitled to benefits as a single parent and can apply for maintenance too.

Is he also in benefits? Only one parent can claim the child element on UC. That would be the same parent will receive more housing element also for the child bedroom.
