Am I married yes or no

Hi every one, I am a newbie and I would be so thankful to you all if you feel my discussion is acceptable as i am at my wits end with worry.

My situation is I am a very happily married woman and my husband is tunisian. My intention was to live with my husband in his country however this plan has now changed as a result of my health and i am unable to get or afford the medication I need in Tunisia, we have both agreed that my husband will now make a spouse visa application to join me in the U.k. (please no cruel remarks about this topic). Our problem is that we got married in his town and on our marriage certificate they have used my birth surname which has been recorded in the marriage registry in his town and not in my legal and current/correct surname that i gave them which contained my current surname in on all the official documents needed in his country for us to be legally married. I am divorced and currently known by and still use my exhusbands surname in legal matters and i am going to change to my new husband's family name after his spouse visa application.
So the big question i am currently unable to get an answer to is am I legally married to my husband in the eyes of the UK government as i have been told by family i am possibly not due to me not being that person named on the certificate, even though I signed every document which was in arabic and i dont understand Arabic in my usual signature and my fear is that i am not legaly married to my husband and my husband's spouse visa will be refused if he applies with my incorrect surname on our marriage certificate due to him being shown as married to a woman with a different surname to mine and if this is the reality my husband would loose a fortune by way of the cost of the visa application being refused on this basis.
What are your thoughts on our situation please ? T.I.A. x

Have you sought legal advice? There is a legal section you can post on, on Mumsnet.

You should contact an immigration solicitor for advice.

You married in your maiden name but still use your ex husband name is that right.

your married as you can't legally use your ex husbands name for marriage.

If you marry properly in another country you need a certificate from the British consulate showing you are free to marry. To get this you need to provide some evidence including your passport. As you've used the incorrect surname, I'm assuming you didn't do that. Therefore I don't think you've gone through the proper channels. I'm married to an Egyptian btw and got married there. What your dp will need is a settlement visa and these days it's much harder to get because you need a minimum income so you need to bear that in mind.

What surname is on your passport?

No idea about the marriage but how long have you have you been out of the country?

Would you be entitled to care on the NHS? I believe the rules around that have all changed.
