child maintenance

My husband (soon to be ex) has been told by the Child Maintenance Service that he has to pay £25 per week to me for our young son. This is despite earning between £5-600 every week. CMS are going by HMRC records from 2 years ago when he was self employed. I have pleaded with them to try to help sort this out. They are not interested in children or their families - that is quite plain to see, because they will not help at all. We split because I left because of Domestic abuse and this is just the final devastating blow to me. He is being allowed to carry on controlling my life, still. Has anyone got advice that could help. He is already living in our mortgaged home and has locked up from the inside, so that I cannot use my key to get my belongings.

Is he now employed rather than self employed?

Once they've set a figure, if you are sure his wage has increased by 25% compared to the figure used in the calculation then you are legally entitled to a recalculation using his current wage. If the increase is less than 25% then you need to wait until your annual review.

Contact 101 about your belongings.
If the house is in joint names then they can help with that as well.
They should be able to accompany you to collect your belongings.
Did you ever report him for DV?
If not, then do it when you talk to them.,

Have you had any support from a DV organisation?
If not, then contact Womens Aid and they can also help you.
Rights of Women may also be a good call!
