STBXH has completely emptied bank accounts???

I have posted quite a few times about my situation.

I have now seen a few bank accounts ALL emptied of quite significant amounts!!

He also has no job and is unable to find another (despite being unable to provide proof of applying for any). Apparently he applied online and no one has got back to him.

Anyway I can't afford to keep my solicitor and have had the first hearing at court. If I keep going to court will the judge award me anything on the basis that you can see repeated large cash withdrawals or will a judge just say "well it's all gone so there is nothing to have" ?

I'm no lawyer but did used to work in a bank... We always froze withdrawals if we discovered a joint account couple were splitting to save the funds and avoid this.

Hopefully someone with legal knowledge will come along but I would think if the asset is "gone" it's not counted...

Maybe he will be asked to justify what he's spent the money on and told to sell or award you damages?

A judge will take account of reckless spending by 1 party, but not helpful unless you have other assets which you could recover. If he has spent the money, you can't have it even if a judge says you should.

thanks yes - i guess if someone is really determined not to provide for their children you can't make them.

I put joint signitures on a joint account when broke up with my ex, it stops withdrawls unless both parties sign off on them.

Just go into the bank and explain the situation you only need one party to set it up.

Doesn't get the money back but stops anymore going out.
