what the fuck are people supposed to do now?

my dsis is having a terrible terrible time with her ex - he has left her with nothing. taken their business, and left her pennyless. he lies and lies and lies. was supposed to have done a consent order to give her a lump sum, got a huge loan and then kept it all for himself.

she is jobless. (he took the business) and is on JSA
she is in rented accommodation that she can no longer afford. HB doesnt pay the full rent.
and today she finds out that legal aid is no longer available after end of march.
what the fuck is this governement doing to people? He left her for another woman. he abandoned their child and fucked off into the sunset with everything they had built up together.
and now she has no comeback because she has no money to fight him for her share.

i cant believe the lengths this shower in power are doing to smother ordinary people.

she rang me today in floods of tears and said she felt like walking under a bus because at least that way her DS would get something.

Yes Its terrifying. God thats awful about yr sister Vicar. My DNiece may well need that kind of help soon. Shes 18 in a week and her stepdad has banned her from reading books FFS. Shes not even allowed to do it on the bus on the way into or from college. First it was just vampire books now its ALL books apparently. I had a massive row with my mum at the weekend.
Because she said "we musnt do anything to rock the boat" or upset DB. Going by my own past experiences (talked about it on here before) i suppose i shouldnt be too surprised that the mysogyny is also going to start with her now shes about to turn 18.

I've been warning that after the end of this month legal aid will longer be available in divorce/family matters since last year, Vic.

How long has it been since he left? Has she not yet made an appointment with a solicitor?

At 18, your dniece doesn't need a solicitor to vote with her feet, darkesteyes.

It's ludicrous that her stepfather has 'banned' her from reading books and I suggest she has a word with her college tutor or counsellor.

izzy its a really really long story.....she had made several appts with several solicitors but its so complex a case most wouldnt touch it.

she was a full partner in their business.

he just nicked everything! just changed it all to his name! bank loaned over 200k which she was meant to get some of - he just kept the money. the bank closed the business account and he opened annother in his name only!

he is getting away with bloody murder here and she hasnt the funds to fight it.she has gone back to a solicitor who didnt really have the corporate expertise but does do legal aid -she is trying to get application rushed through.

its absolutely shit.
she has 3 issues.
the consent order he agreed on he has now reduced by 30k
the bank closed the business account and reopened it in his name only despite her being a ffull partner in the business. so he has just waltzed off with everything.
he has tried to get the accountant to just hand over everything - accountant said no - so he sacked her! he was trying to get everything changed to his name only.
she owns 50% of the business. Also the property. its all a bit of a nightmare.

Why did the bank close the business account? Was it in their joint names and did the bank close it and allow him to another on his say so only, or did the bank close/freeze it because it was overdrawn or similar?

no - the first option - they fucked up royally. they closed it and just allowed him to take control and open a new one - but in his name only. She is going after the bank....she had a 50% share in the business and he just closed one account and opened another - then sacked the accountant because she wouldnt hand over her stuff to him.

he then found a dodgy accountant who promised he could sort it (which he obviously couldnt...)

he just ousted her from teh business.
but he knows she is desperate so then offered her a "revised" settlement minus 30k!! he is a manipulative devious little shit.

Mmm... interesting!

Although it may seem complex, I would have thought resolution of financial matters would be within the capabilities of a solicitor experienced in divorce and family law and, presumably, the one who's trying to rush through a legal aid application at this late date has the necessary expertise.

As I'm propping my eyes up with matchsticks I'm going to take my leave of you and come back tomorrow night after having given your dsis's problems further consideration.

In the meantime, I see no reason why she won't succeed with a case against the bank and I suggest you take a look at the Fraud Act as there may be probable cause, and more than a few phrases, for your dsis to do engage in sabre rattling in order to put the fear of the long arm of the law into him concentrate his mind on his need to act honourably Smile

If your sister can't get legal aid it's because her income is too high. So she's just in the same situation as anyone else who wants to sue. All she can try is to persuade a solicitor to take it on on a no-win, no fee basis.

she is not on any income cognito - she is on JSA. she was a partner in her ex business but he got the bank to close the joint account and open another in his name only last year.

Thing is Vicar with this stupid cancelling of legal aid i can see people exacting their own justice and then it will be people in your profession who will have to deal with the fallout.

i said that too darkesteyes and i can see reports of DV going through the roof too as thats the only way anyone will be entitled in the future. its going to cause a nightmare for so many people.
