Advice on finances in separation/ divorce from woman who have done it and earn more than Xp

I've just been looking at the child maintenance calculator but it doesn't really fit our situation. Both work full time and I wouldn't describe either of us as the 'main carer' - it's a 50 50 split in time (although much more like 80 20 in terms of input). I earn significantly more than H.

If we separate and I stay in the family home I am assuming I'd be entitled to nothing from him. Is that correct?

If it's a 50:50 childcare split, he may well be entitled to maintenance from you.

You say XP, so assuming you weren't married, neither of you would be entitled to spousal maintenance. Child maintenance - if you split 50:50 then no need to pay each other anything.

As far as I know, child maintenance can be claimed by the person who receives the child benefit. I earn more than my ex and we have 50/50 custody. It would never occur to me that it was morally ok for either of us to claim maintenance from the other whether we were legally allowed to or not. Obviously we split child related costs.

Best thing to do is to try and summarise your financial position and take it to a solicitor for an hour's advice. Some will give you a free hour. Given the childcare situation and your relative salaries you'll need someone with more detailed knowledge to get an accurate position.
