Party Wall Notice - excavating with 3 m

Hi, Dont know if anyone can help but we have just found out a week into our build that we should have notified one of our neighbours of our intention to build within 3 metres of her property.

I seem to be reading that is is only if our foundations will be deeper than hers - but how would I know that?

She doesn't seem to be funny about it and says providing her 'adviser' thinks that plans look fone she'll sign it all and backdate it next week I just need to speak with my architect and maybe the planners to see where I stand.

Don;t want to go down this route if I don't have to. Any advice from anyone who has experienced this? Do I just issue notive anyway to be on the safe side?

We are having a rear extension also and she has said she is happy for us to carry on with this and is allowing access.

Any advice really appreciated as waiting till MOnday to speak to someone is going to kill me!

This has the information you need.

You will need to write a letter to your neighbour and they will need to reply that they agree to the work being carried out. If you look on the link there are sample letters for you to write.

We did this last year and our neighbour got advice from Citizen's Advice before confimring in writing for the work to go ahead. We gave less than one months notice though.

As far as I understand it doing it now, if your neihgbour agrees, shouldn't be a problem.
