For those who might be wondering what is going on with my building saga.

Well he put in his defence to our counterclaim. Total lies and was not able to argue anything against our points, and put his foot in it a few times trying (highlighted things we evidenced by trying to demonstrate something else!).

We have received a date for a preliminary hearing for the judge to look at the usefulness of an independent joint surveyor. We will be going to the hearing fully supporting this proposal even though it will cost us money, as cost will have to be split between both parties.

I am very pleased, it is what we wanted, as the surveyor will highlight the truth. He/she will show this scum of a man to be the fraud he claims to be as the loft conversion is still clearly not done according to plans and there are visible errors which we cannot fix due to cost (uneven plastering, sloping walls).

So, while he is (hopefully) bricking it for taking it so far, we are jumping around seeing a possible end in sight in our favour. Fingers crossed.

Life as a mother to 2 is wonderful! No sleep, but hey who needs sleep? sleep is for the weak DS is a chilled out calm lovely little boy. Apart from right this second as he is yelling for more milk .

DD loves her new room, so much so that she does not want to sleep in our bed with us at the weekend when we have friends staying over, she does not want to share her bedroom , I would love to say i love the room now but that is a lie, i keep being reminded every time i clout my head on a beam that it is not right, but it is less raw now. Once this court case is over, we will put it behind us and move on. However for now, every time i see a clapped out white van, or even hear anyone talking in measurements, my blood goes cold!

fimBOW Its amazing what not constantly vomitting, not having a cowboy builder in my house, having my home back and decorated (apart from bedroom), dd in her own room and not least a most perfect little boy can do for one's sanity

Glad its all going in the right direction in terms of taking this scum bag to the cleaners. I really hope that it works out in your favour but sounds like its still a long journey ahead of you.

Thank you all. We also have the old apprentice willing to be witness, he took photos of the work he was doing, and says that this builder ripped off his previous job too (which he was finishing just before he started our job but after we had employed him). This guy was not happy with some aspect of the final work, and wanted something changed as he was not happy, builder said it would cost more (although it shouldn't have) and charged this guy a fortune to do it. This guy paid him as the builder threatened him. I recall now the builder telling us how the last person did not pay what was owed and so he 'got heavy' (he told us near the end of our 'contract' before we fired him).

We have some touching up to do here, some cracks have appeared (am hoping just settling cracks in the plaster), and we shall leave that.
