Vacating notice

I need some advise if landlord is correct.

we are on verge of vacating rented house to move to our first home.
we want to give notice to land lord.

we moved in 29/12/2020
signed rent contract for 6 month on 04/01/2021.
Pay monthly contract on 29th of every month.
After 6 months never signed another contract but it kept going and we now have lived in house for 6 years on kind of rolling contract.

now landlord is saying that vacating notice will be 2 months( instead of 1) and vacating notice date will start from 4th November (because contract signed was 4th January) even if we inform him about vacating today on 18th October.(quoting new rental laws). He said new laws will apply on us despite we were living here since 2020.

is he right?

I'm afraid the new laws do apply unless you have a current tenancy agreement stating one month

Look at your original tenancy agreement.
"If your tenancy agreement states that it is a rolling tenancy from the start, then the notice period in your tenancy agreement still applies. For example, if your tenancy agreement says you only need to give one months’ notice, you do not need to give more."

It wasn't a rolling tenancy from the start

Under the old law, when an assured shorthold tenancy (AST) ended its fixed period, it automatically became a periodic tenancy.

Actually, this is the bit I should have quoted, as I was assuming the tenancy agreement stated it had turned into a rolling tenancy:

If you had a fixed term tenancy and the end date was before 1 May 2026
If the tenancy agreement has rules in it about what would happen once the fixed term ended, the notice period in your tenancy agreement usually still applies.

For example, if the tenancy agreement states that when your fixed term ends it automatically turns into a rolling tenancy, the notice period still applies.

If your tenancy agreement does not say what happens after the fixed term ends
The notice period in your tenancy agreement no longer applies. You’ll need to end your tenancy using the process for assured periodic tenancies.
