hi all ! some of you may remember me from my last post but the situation is now gone out of hand to the point where i had to take time off work due to my asb neighbour.
I’m looking for recommendations for a good property litigation solicitor, ideally someone with experience dealing with housing associations, leasehold properties, noise nuisance and breaches of tenancy agreements.
I own the ground-floor flat in a converted house, while the housing association owns the flat above and lets it to a tenant. The upstairs tenancy agreement specifically states that all rooms, apart from the kitchen and bathroom, must have fitted carpets. However, the flat appears to have laminate flooring throughout.
The lack of carpeting means that normal footsteps, stomping, furniture being moved and other impact noise travel directly into my home. This has been ongoing for a considerable amount of time and has contributed to a wider ASB situation. I have repeatedly asked the housing association to investigate and enforce the carpet requirement, but no effective action has been taken.
I’m particularly looking for a solicitor who could advise on whether the housing association has a legal or contractual duty to enforce this clause and what action I may be able to take as the affected downstairs leaseholder.
Has anyone dealt with a similar flooring or carpet-clause dispute and had a successful outcome? Can anyone recommend a specific solicitor or firm, preferably in London or one that works nationally? A firm offering a fixed-fee initial consultation would be ideal, as I would like someone to assess whether the case is viable before I commit to substantial legal fees.
