Legal action - 3 years and not complete

In 2023 my husband and I purchased a shared ownership property. We exchanged and informed completion would be three weeks later, however just before completion it was pushed back for a couple of months, just before the couple of months was up, it got pushed back again and so forth.

At this time we where kept upto date and therefore we never pulled out. We could of pulled out a long time ago however as it's a shared ownership we are limited with purchasing another property and also because we kept being promised completion dates we held out.

The reasons for the hold up are builders going into administration and also issues with local councils and roads.

We have enrolled our daughter in the school local to the new home and are renting close to the area, however we still have not completed. Not only that but all updates have stopped and I'm getting no response to emails.

To get another shared ownership would mean moving out the area, moving daughter school and also paying a lot more money due to price increases in the last 3 years

What can we do, would we be able to take any legal action? The shared ownership is with a housing association

This is way beyond our pay grade - you’ll need to get your solicitor involved. If you’ve exchanged, you’re in a contract - they’re breaking contract.

Are you sure you exchanged? Did you pay a deposit? When you exchange it’s legally binding.

do you mean that the builders have not finished building the property? Does this affect only you or are there others in the same situation? If you can, join up with other people who are also waiting on completion.
