DH works abroad, so we let our flat but now are coming back to UK - if we sell the flat when the tenenacy expires(bit too small now as have had 2 more children) and have to wait for 6 months until we get back, do we count as people who have no mortgage? How can we preserve the fact we have had one for 5 years and never been a problem?

It'll show on your credit record, eg experian.

Remember that CGT will be payable on the sale of your flat unless you move back in prior to sale.

I am not sure CGT will be payable, mumblechum, as it will count as PPR for MLTN, unless she has another main residence in the UK - I presume MLTN is a non UK tax payer and resident, but still Uk domicilied?

You will count as a cash buyer if you have sold and are mortgage free, but as mumblechum says, experian will record your satisfied mortgage. Your issue may arise over your Uk residency ( or not), ie you may not be on voters roll etc. Lenders are rejecting mortgage applications for less, at the moment.
