Changing mortgage into my name and land registry

Hi, I hope you can help.
My ex's name is still on my mortgage and deeds/land registry.

How do I swap it over to solely my name? Do I need a solicitor, or do I just apply for a mortgage in my name and change land registry separately?

I have his consent.

You'll probably need to instruct a solicitor to help with this. Your (new) lender will require that their part in this transaction has legal representation (which you pay for), so you may as well instruct a solicitor who will also represent you and the lender at the same time. Make sure the solicitor is on the lender's approved panel.

This transaction is known as a Re-mortgage and Transfer of Equity.

The solicitor will also liaise with the current lender with regard to redeeming the outstanding mortgage and whether or not monies are to be paid to the ex for signing the property over to you. The lender will check whether there are any early repayment charges to pay.

Your ex may decide not to instruct a solicitor to represent them, instead are happy to sign the papers that your solicitor sends out, but of course they do have the right to get legal representation should they want it.
