Bathroom leak and shared building insurance

My bathroom has leaked into my downstairs neighbour twice. Both times a number of plumbers came and couldn’t find anything as it was not visible from my bathroom. However they did not remove the bath panel as they did not see it was necessary after the other tests carried out.

We are now claiming on the insurance as I had to pay for a leak detection team to come in. They have found the potential source of the leak after removing the panel and given me a report.

My neighbour is now asking to see this report and I have a feeling she is going to blame me for not removing the bath panel sooner. I have kept her informed of all the works that will be done and I plan to resolve this ASAP as I could do without the hassle.

However does she have the right to have a copy of the report? Whilst I don’t want to cause any awkwardness I also do not want to be blamed for any of this....I mean who causes a leak intentionally?!

Any words of advice would be appreciated!

As you paid for the leak detection team, I don't see that she has a right to see the report.

How about explaining, roughly, what they reported verbally to her as a compromise.

You will be liable for any damage done to her property even if accidental rather than negligent though so what difference does ot make whether you show her or not?

I assume you or your insurance will.be paying to rectify any damage including stain blocking and redecorating of her ceiling here water has gotten through and stained.

Thanks both - I have emailed her and explained roughly what they checked however she has asked to have a copy of the report and as I have paid for this and I am now claiming the cost on the insurance which we share I think she thinks she has the right to see this as it will mean that our premiums will go up.

The cost to the damage is minimal however we have both agreed to claim this cost on the insurance also.

The repair works to my bathroom to find the leak will not be covered and I will personally have to cover this!

Such a stressful situation!!
