How does party wall agreement work when your neighbour is selling?

We are planning some building work in the summer that will need a party wall agreement with our neighbour. They have just put their house on the market. Would any party wall agreement be with the property or with the owners? In other words, would we potentially need to do the agreement (and any surveys/costs) twice if the sale takes a while to go through? Or could the current owner make the agreement with us and then this hold with the new buyer?

We are in exactly the same position that you were in last year and lots of web searches have brought me to your post. Did everything go OK for you? Our neighbours are saying that they are not sure if they can legally consent to our works under the Party Wall Act because their house is on the market. We’re hoping our build could begin in the autumn and so have just served our formal notice.
