Any conveyancing lawyers out there? lifting charges

Yes I am asking for free advice but a link will be great.

I have a charge on my house. I have paid the charge. The person who had the charge isn't prepared to sign a release of the charge. I have no other monies outstanding to him.

Where do I go next? is it county court or what?

Do you have evidence that you have paid the debt secured by the charge?

Phone the Land Registry & ask@

Why isn't the chargee prepared to give you a discharge ? Is the charge there against money loaned or is there more to it than that.

Basically if you can redeem the loan, the law is on your side.

Can't see the LR willing to help - I find them helpful, but only in areas within their remit. This ain't it.

Yes, I have evidence of payment to him of the exact mount on the charge and have sent it to his lawyer.

The quarrel is between him and my soon to be ex-P. As far as I know there is no money outstanding but whatever, I'm not sure why I'm caught up in the middle and what I can do about it.

Will try the Land Registry.

Any more advice welcome

Hi OP, You don't need a property lawyer - you need a banking or litigation lawyer. The conveyancing part is easy if the lender deals with the forms (it's invariably a DS1) but if there is a dispute then I'd find someone who can look at this for you. The Land Registry won't be able to help you with this as they will need the completed form from the lender. HTH.

Thanks everyone. Am getting STBXDH to track down all monies, payments and interest so he can present his case to the other person and leave me out of it. But meanwhile I'm still stuck with the other person not prepared to sign the DS1 and am fearful of the costs of litigation esp since the other person has millions.

Resurrecting this thread. Anyway I can find a good lawyer ref litigation to try to get cancellation of charge? Would law society be able to help? am in boondocks so need a savvy lawyer and not impressed by local firms.

No input on your problem, I'm afraid.
But I wonder if starting a thread on the Legal board might be helpful to you? Some answers there are from non-lawyers, but there are some jolly helpful and experienced lawyers there too.
