Stamp duty

Hi all, I’m currently in the process of divorcing and I am buying a new property. Ex is buying me out of marital home and we have a btl.

My mortgage is conditional on being off both other mortgages, and to avoid the obvious stamp duty issues I want to be off them both too.
So now it’s come to getting the btl re mortgaged and the broker has just advised us that by taking my name off the mortgage it will leave stbxh with a stamp duty liability. This doesn’t seem fair/right to me...does anyone know if if this is correct? He isn’t buying, just remortgaging to take my name off Confused

He is buying your share in the property though..

However, I thought there was an exemption on divorce (but possibly this only applies to the family home)
