I will try and keep this as brief as I can .
Had a new fence put up on my boundary ,neighbour after workmen left went and pushed and leaned on every panel sending it out of alignment.
Cost me £1000 to have it put right. While waiting for it to go to court he spent months sneakily leaning up it when mowing his lawn by it not enough movement to be picked up by my cctv. Though him wrecking it was caught on cctv as movement could be clearly seen when he was leaning etc on it,
Fence guy said if he keeps leaning on it it will weaken the posts in the ground. Then we had that bad storm and sure enough with weakened posts fence went out of line again neighbours was stood outside laughing his head off.
Court case came he claimed wrongly it was his boundary and my fence had been put within his boundary therefore he only damaged his own fence.i pointed out to the court my fence was actually within my boundary and offered the court the boundary plan proving it was my boundary but no one asked to look case was dismissed because magistrates said they didn’t know who owned the boundary.
Hmmmm I offered them proof.
Anyway I refuse to spend any more money getting my fence put right as he will only be at it again .
Now here’s my problem any opportunity he leans up my fence like today he was building something near my fence and would stop and lean up my fence, I tried to do something before when he was doing it while cutting his lawn by it but police said he well may be doing it but angle of my cctv doesn’t show actual contact or movement before when he wrecked it movement was clearly seen.
I’m really getting fed up with this some of the posts are loose in the ground after the storm but even if I did want it putting right again he would not allow any fence firm to put a foot on his land so it’s a non starter anyway.
But then today I was out in my garden heard him talking to his other neighbour and heard her say about taking the fence up ,now she hadn’t got a fence her boundary is hedging the only fence that side is his home made picket fence and he only put in new posts the other year so the only other fence she could had been talking about is mine.
Now as he claimed in court it was his boundary and my fence sat within his boundary therefore he only damaged his own fence which he lied about .
I’m worried that it’s my fence that was being talked about.
So what do I do if he starts taking my fence down and going to use the same excuses he did in court. The case was dismissed so it wasn’t like they believed him just said they didn’t know who owned the boundary.
I have a copy of my boundary plan and his boundary plan his is the other side of his garden.
I also have my surveyors report stating it’s my boundary.
So would this be a police matter if he starts taking my fence down I’m worried in case the police tell me it’s a civil matter because by the time I’ve then contacted who ever I need to contact he would had by then got my fence down and I have dogs I need to keep secure.
You see he built a tall fishpond and part of it actually is over my boundary .he has a big garden about 140 ft and wide but he put it right next to my boundary he was pulling it to get it as close as he could but couldn’t pull the other end as close .so when I purchased my council house the council found this out when measuring the boundaries but decided not to take action.
So when I had my fence put up it was impossible to follow my boundary line for about twenty foot because of his pond so of course my fence went up right next to his pond which he did not like .
Also just before I had my fence put up he brought home on a trailer a big wooden structure with netting on which I think he planned to put over his pond of course when my fence was put up he had no room to put this structure on so that would had been more encroaching my boundary as it was wider than his pond.
So I think he is planning to take up my fence so he can get to this side of his pond. Like people have said with such a big garden why did he have to put it where he did.
So looking for advice on what to do if he does start taking my fence up.
I want to be prepared on who to call as I’m really worried.
I won’t go outside to confront him as through past experience he is a nasty vile piece of work.
