Flying freehold?

I am looking to offer on a mid Terrace property that has what is described as a shared pathway between the house and the neighbouring Terrace. One of the bedrooms to the house I am looking at goes over the pathway and connects to the next house.

The vendor is unaware of the legal situation of this and whether he legally owns the pathway and the others just have rights of access or if it is one of these dreaded "flying freeholds" I know nothing about but am told the legal situation is messy.

Does anyone know where/if I can find out this information or have any experience of something similar? I don't want to get too far into the process and find myself in a legal quagmire.

Your solicitor should sort that out, make the offer based on no issues with that and tell your solicitor to check that first.
