Leaving my flat, but no section 21 notice

My landlord has put the rent up above what I can afford and I will be moving out of my flat (don’t worry, I have found somewhere else and that side is all good).

However, I have never had a Section 21 notice. The agency say that it was sent on 19 July, but I’ve never had it. I’ve asked a couple of times for another one, but it has never come. I do have an e-mail stating that my 2 months are up on the 1st October and I’m happy to go by then.

What I’m worried about is what happens if I do not get one and leave on the 1st. Am I still liable for rent on the old flat? Am I supposed to sign anything? Or can I just go?

Since you only need to give a month's notice, just send a letter and email to the agency saying that you no longer want to rent the property and will be moving out on xx date. If the agency is managing the property, then it is up to them rather than LL to serve a S21, I expect they just haven't bothered if you've agreed to move out.

Yep. If you have agreement in writing of the date of the end of your tenancy then you don't need a section 21 notice. That is notice seeking possession not notice to end the tenancy.
