Our solicitor called today to say our land search has come back saying it's showing that the seller could be using some land that doesn't belong to her. The solicitor said if this is the case then additional 'things' need to happen. Additional 'things' sound expensive to me! If it does come about that the seller is using land she shouldn't does anyone know what would happen. I actually don't think this is the case as the building is only 10 years old and nothing has been modified and the solicitor said it's only a tiny bit of land.

I suppose my question is can we take anything off the price of the property if more costs are occurred by us because of this problem?

The solicitor has said she will send the plans over in the next couple of days and asked if we can go and investigate....... useless.

Not useless at all: this is exactly what you are paying for. Your solicitor is suggesting you go and have another viewing and see whether the plans match up with what is on the ground. It is your responsibility as the buyer to be sure that you are buying what you think you buying. If you are unsure what exactly you need to do then ask your solicitor for more information and for details of what the issues may be and the likely solutions.

Quite possible that part of the garden is not actually part of the title you are buying, but has been used as such for x number of years.
