Sewer build over agreement

Would anyone know if we can start building work (digging of foundations at least) whilst one of these is processing?

Building control have flagged we are building within 3m of a shared/public drain. Builders are due on site after Easter and it's a 4 week turnaround on this latest 'issue'. Architect probably won't even get round to doing the paperwork this week as he's busy... Hmm

And £950 fee!? Sad

950? Thames water were only 300 and I though I'd been mugged!
Tbh the architect said it's all definitely fine, they just like to rubber stamp it. The rules are very simple so you can just crack on.
