Do we still have permitted development rights?

Hello - are there any kind planning experts out there?

We finally got permission to build an annexe in our garden, hurray! It has been granted with the following condition:

The development hereby permitted shall be carried out in accordance with the following approved plans: Site Location Plan and Drawing nos XXXX

In the original plans there is no velux window in the rear pitched roof (which faces away from all the houses and into a park the view into which is completely covered by trees). We would quite like to put one in, and as we understand it you can put a velux in under permitted development.

Because our planning permission says we must build in accordance with the plans we submitted does that mean we cant now put in a velux under permitted development?

I would call the planning officer for advice. Always better to get there interpretation. Has pd been removed as a condition of your planning permission?

Hmmm I suspect putting a helix window into an existing structure is in permitted development but if it's being put into something else it probably needs to be approve - IYSWIM? I'm not an expert but we built an extension under permitted development and we still had to submit the plans and have them approved. A lot quicker and much simpler than full planning but still needed to be done. Also had to be signed off by a planning officer.

I'd check for certain but expect you need to resubmit altered plans.

I can't call the planning officer unfortunately because she has been extremely objectionable in this whole process (we got costs awarded in our appeal for their unreasonable behaviour) and also she never answers the phone ;)

Could possibly ask the duty people though although I think they have a new policy that means they are basically as helpful as a chocolate tea pot.
