Party wall agreement - neighbour changing roof design

Hi - just wondering if anyone can help with this please? We had an extension last year (Victorian semi) and NDN eventually signed our party wall agreement without requiring party wall surveyor involvement.

Our NDN is now planning a v similar extension, so I signed his party wall agreement too.

However, he keeps changing his mind as has seen a different type of roof with big glass pannel that goes all of the way across it. I think this would require plans to be ammended and structural engineer involvement.

Can I declare party wall agreement null and void in this situation? Thanks.

I don't think so unless the works were specifically named and laid out in the agreement. Will he need planning? Building regs will ensure it is safe. Is it more likely to damage your property. The agreement states they must make good any damage to your property regardless of what they do to theirs.

Thanks - I have been in touch with our architect who has said it is a material change which will require new structural calcs to be submitted for building regs and need detailed plans for us for party wall award. It will put quite a load on the party wall.
