Buying a house with a current party wall agreement

Can anyone advise?

We are due to exchange shortly on our new house. There is current building work being done next door and a robust party wall agreement is in place.

A surveyor has done a detailed report and taken all necessary photos. Work has commenced.

Does this agreement transfer to me, as the new owner? Part of the agreement is for my driveway to be replaced, along with my side gate...will the builder next door have to stick to the agreement despite the agreement having the previous owners name on it?

We just had similar, and the agreement was personal to the sellers so we didn't get the benefit on completion. As it happened the work was completed before we completed but our solicitor was working on several options just in case. Not sure what those were other than assignment of the contract.

What has your solicitor said? That's what you are paying them for surely?
