still waiting on lettings agents returning deposit any advice

Moved out of my private let home on the 24th of oct gave the letting agents the appropriate amount of notice and got a letter saying my deposit will be sent back to me within 14 days after I moved out
its now the end of nov and I have not recived anything yet
I left the house clean did go over it with a hover mop duster etc so if there is any dust its not my fault
can they with hold my deposit etc?? Any advice will be helpfull

Have you spoken to them about the delay? That would be the first thing to do.

Ive sent a email so that I can prove I have contacted them also tried phoning no answer yet!
Iam entitled to this back am I not

If you are in the UK then your deposit should be in a deposit protection scheme. Email the letting agents (so there is a written record) asking when you can expect to receive your full deposit and asking them to confirm the details of the scheme it was held in.

iirc some of the schemes can take up to 28 days to return your deposit.

It's illegal not to place it in a scheme so if it wasn't in one you are entitled to compensation. If it was in one, then the criteria for with-holding some of your deposit is pretty strict and wouldn't apply if you only left the house a bit dusty. Also, when it's in a scheme, you both have to agree to any deductions to cover the cost of any cleaning or damages, so the letting agent can't just arbitrarily decide to not pay your deposit back.

Already have sent a email
the letter I recived said 14 days after the 24th of oct im going to give it to at least fri and if no word or no deposit will be phoning again
going to look out my info pack I got when I moved in had info on deposit schemes
I know there was damage but that was nothing to do with me shower had bust (not the first time happened to a previous tennant) still got photos I took of the damage with the letting agents know of

I wouldn't even wait til Friday! If you were told 14 days then something is holding them up or you were given false information!

if it was with a deposit scheme however, you're safe so don't worry! (but still chase)

I know that DPS sends an email to the tenant which they have to respond to in order to trigger the deposit return. Have you received any such email - including checking your spam folder if you registered giving an email address? Also, since you gave your details when your deposit was registered, have you changed your bank account at all?

Your LL, or the letting agent if they are acting for the LL, has to discuss any potential deductions from your deposit and either get your agreement or you have the opportunity to raise a dispute. A pp has pointed that out already.

Find your info pack and either log into your account or ring the deposit scheme to find out what is going on.

When you moved out, an inventory check should have been carried out with you present - ideally both tenant and LL sign the check out inventory: did this happen?

No invertory was done on check out no one was there no phone call to say ill be there at such time etc even when I handed in keys nothing was said about them being there and me not only phone call I got was cause I overpaid them to much rent which I got what they owed me back

Well they don't sound to be up to much from what you've posted here. I'd check the deposit account - you should have the details - and I think I'd be visiting their office pronto.

contact the deposit scheme ASAP.

BTW your contract was presumably with the landlord, not the agent - the landlord is responsible for deposit protection. Wonder if the landlord knows how bad this agency is?

I've heard that none of the previous tenants have lasted
Did get a reply back the other day said they were getting on to it so good knows how long phoning them again tomorrow then if no any far forward seeing CAB about this

you need to contact the deposit scheme concerned, that is what the CAB will tell you to do. Did you find the information?

You need to talk to the deposit scheme. They'll release your deposit themselves if you're over the allocated time, which it sounds like you must be.

You should have a reference number for the deposit from when it was first registered.

I don't get this thread: it's six weeks since the OP moved out and still no deposit back. If that were me, I'd be playing merry hell with the agents and would definitely have contacted the deposit scheme by now.

Even if you have lost the registration info there are only three schemes AFAIK so using the address it wouldn't take long to check who has the money.
