Hello, hope someone can help me on this. If the work done by a builder is poor and the builder refuses to put it right, can I deduct the cost of another builder putting it right from the contract administrator's fees, if necessary? If not, what is the role and liability of the contract administrator here? I'm wondering what happens if the amount still owing to the builder does not cover the work.
Like many I didn't expect to find myself in this situation and now find that the contract the work is based on (ACE agreements) is not only very detailed and in multiple parts, but also doesn't seem to be available without paying a fair bit of money for each part. I don't even know which part I need!
Does it make a difference if the work is a variation initiated by the client, so not part of the original agreement? Thanks.
