Builder's BIG mistake with drainage?

Don't know whether anyone out there can help me with this? We had an extension built about 6 years ago, to architect drawn plans. Building control signed off etc. BUT the builder has channelled the gutters into the same drain that runs into the septic tank. We share the tank with our slightly difficult neighbour, and now want to get our own installed. Problem is, it is a complete NO NO having surface water draining into the septic tank. Builder is coming tomorrow, but is already making excuses as to why he had to do it that way. Where do I stand if he hasn't followed the plans? Architect died 5 years ago and only found out when I rang his home just now Blush Building inspector half wit receptionist didn't reckon it concerned them. Where do I stand with this? If it wasn't viable surely shouldn't the builder have told us 6 years ago?

Feeling very stressed by this now!!
