Gazumped. Twice! Anyone tried to get expenses back?

Title says it all. I know we have no legal recourse to claim our legal/surveys/mortgage fees back, but oh how I want to.

The first gazump cost he over £2k in fees and I would LOVE to invoice the "seller" for that amount. We'd waited 6 months to buy from her because she couldn't exchange on the house she wanted... Then because if the delay, she said she now wanted 10% more money. ?!

Second house only cost us £28 but again, I'd love that back.

There should be some recourse for sellers who do this. Has anyone tried to get anything back?

I agree with you, you should be able to get that back unless you are the ones who pull out. It's criminal that sellers can do that kind of thing without having to reimburse what the buyers have spent.

I'm so sorry to hear you have been gazumped, I know how it feels as I have been gazumped 3 times and spent 6K ,unfortunately there is nothing we can do.I have tried the third time around and was told as there is no pre exchange contract I can't get anything back.I have now found a house and waiting for mortgage offer to come through. I'm sure you will find your perfect house soon.

Thank you, GR. good luck with your new purchase! Have you considered having a pre-exchange contract drawn up, where you both put it 'earnest money' to stop either side pulling out?
