Ending of tenancy

Our 12 month tenancy expires on 29th April - the landlord (via the agent) has given no indication of whether or not he wants to renew so we've no idea what is going on. I was under the impression that if we weren't notified today then we go on to a rolling two month notice? So the next time he can give us notice is 29th March (our rent is paid on 30th of each month) - am I right?

yes, I think so - it is two months notice for him and one for you, coinciding with those dates.

time to kick the agent to see what the plan is.

Word of warning if you do want the flexibility of a rolling contract ? if you kick the agent you will probably have to sign another 12 month tenancy. I got myself roped into one once when I didn't realise that if I'd left things alone it would have been fine (at the time a month by month would have worked out better for me).

Are you sure that you were not issued with a Section 21 Notice at the time you signed the lease. Many letting agents and landlords do this as a matter of course to ensure that the lease ends after 12 months so it is worth checking.

Most landlords are quite happy to continue on a rolling notice although letting agents would rather get you to sign for another year as they would then get the commission up front.

It's been a really strange tenancy from the start - an accidental landlord who doesn't know whether he wants to keep or sell, and we've had endless faffing around from both him and the agent. A couple of months ago there was talk of a 6 month renewal which we would be happy with, but the agent handling us has been "promoted" (yeah right) and I've no idea what's going on. I spoke to the agents on Monday about something else and she made no mention of it at all.

I've been through the agreement and can see no mention of anything about ending the tenancy except it ending on 29th April. I'm loathe to ring them up again so will keep quiet for now.

??? Why don't you want to speak to the agents? Just demand to speak to someone who knows what is going on.

letting agents are famed for incompetence, but be enough of a nuisance and you will get past the monkeys.
