Who is responsible for drain?

Or maybe it's a gully? There is what I would call a drain on my neighbour's property, which takes the water from the guttering on both houses (terrace). We would like it looked at as suspect it may be causing a patch of damp on one of our walls (there is also similar patch in her house) and would like to at least eliminate it as a possible cause.

In theory, I would be happy to pay costs, but am thinking that if it's on her property then maybe she could claim on insurance, which we couldn't. Any ideas?
