Has anyone actually been through the whole cycle of eviction & what would you advise another family of, now that you know? I have been advised of the procedure by the council - but it does not actually say what happens in terms of what type of housing is offered after, the bailifs etc. Would love to hear from you. Am currently an insomniac Googling everything from legalities to depression (as a result of this situation) :(

I was evicted from my private rental just over a year ago, due to rent arrears, but they came about due to disability, so I was considered unintentionally homeless.
My council don't put anyone with children in B&B, and I got a perfectly decent flat.

I am renting privately & the reason for our arrears, was due to my partner & I both losing our jobs.
I've been told not to make myself intentionally homeless. So I did not act in the 2 months notice to leave - which coincided with the end of the contract. I'm now in limbo with no new contract & the landlord has sent an email specifying we must leave. So I'm just wondering if the possession order now kicks in? How does that work?

I was given an eviction date, I could have made them evict me through court, but the council didn't make me, they just housed me.
You really need to talk to the homeless department at your council.

I think you need to talk to the Shelter helpline. They should be able to talk you through the rest of the process.

Didn't you claim housing benefit, Belle? Shelter are really helpful. It's likely that your landlord will go to court to seek possession, after which you'll be given a date in which you need to leave by. Are you able to save for a new deposit? Would your landlord be prepared to let you stay if you sort the housing benefit out?

I think the landlord needs to got to court to seek possession as LadySybildeChocolate has said, the court will then serve you with papers with an eviction date and on that day your landlord can come with a court appointed bailiff to evict you from the property.

I have been through it myself but was lucky to get a property on the day of eviction, the council were useless and eventually offered me a property two years after I had initially been evicted from the property.

I think you need to keep onto the council as otherwise they will brush it under the carpet and you'll be forgotten about :(.
You shouldn't just leave it though and make yourself homeless as then it's your fault and they don't have to act to re-house you, so try and stick it out.

Thanks so much for all the tips & advice. I am on housing benefits, but there is a shortfall as the entire rent amount is not covered.
How long does it take on average to get a possession order done? Then, how much notice is usually given on the possession order to leave the property? From what I understand thus far, it's at that point of receiving the possession order that I need to take it to the homeless department of the council?

MissyB890 - how did you manage to find a property? Privately? With me being unemployed for 7 months, I doubt any new landlord will want to take someone on with housing benefit...?

Get in contact with your council's homelessness office first thing Monday morning! They will arrange a meeting and determine if you are unintentionally homeless. If you are not, they will house you in temporary lodgings upon eviction or possibly before.

It's possible your council has a list of private landlords who are willing to take on tenants who have been evicted or are on HB. But start with the homelessness office.
