can someone please explain to me in simple language what this clause about notice period in my contract means??!

hello

i've googled this and there's a lot of info on the web but i just want a simple answer about what i should do rather than trawl through lots of legaleese!! the clause is:

'whilst the tenancy is periodic, the one month's notice must expire the day before a rent due date'

my rent due date is 20th. we are planning to move out early march. when is the latest that we need to give notice? we thought early feb, but this seems to suggest 20th jan.

can anyone help?

It means that you can leave on the 19th of the month, and so your notice should be given to allow at least a month's notice.

So in order to leave in march, you need to give notice by 19th fabruary, and you would leave on 19th march.

Yes you are right - the latest you could give notice would be 20th January (although some people might say 19th January to be sure) and you would then need to move out on 19th February. Alternatively, you could give your notice on 19th/20th February to move out on 19th March.

You might be able to negotiate a different date to move out by mutual consent with your landlord but that would be completely at their discretion.

many thanks, i think we'll try to get the landlord to agree a different date, after all they'd be getting a couple of extra weeks rent!

i don't really understand this rule though, i don't get how its supposed to benefit the landlord...
