what the hell happens now - legal question re completion

Selling our house. We couldn't find the certificate for the gas boiler service from September.

Last week buyers solicitors insisted we have it serviced again, we agreed and they put the following clause in the contract (exchanged on Friday)

The Sellers agree to arrange a gas service by a suitably qualified engineer at their own cost prior to completion, and to provide a copy of the gas service document to the Buyers solicitors. It is agreed that if the gas service document indicates that any repairs are required to the central heating system the Sellers will meet the cost of the said works. This clause will not merge on completion so far as it remains to be performed.

The earliest we could book the service for was this evening which we told them.

They asked to complete tomorrow, we agreed.

Bloody f-ing gas engineer hasn't turned up. What the hell happens now. We're still willing to go ahead tomorrow and pay for the cost of the service once the buyers are in but is the buyer solicitors really going to delay completion over a boiler service??

Seriously stressed Angry

Oh no, not surprised you're stressed - moving house is stressful enough!

Sorry I can't help on the legalities but maybe a solicitor will read your plight and be able to advise. If your buyers have been nice up to now then maybe they won't mind this happening after completion?

Otherwise is it worth calling up your gas engineer that didn't show up and demanding he show up, have you spoken to him? Anyone else who could be called at short notice tonight, they must have emergency gas people about!

Are you due to actually move out tomorrow? I'm sure all will be fine, it's just your last hurdle before you get to move. If you can't get anyone out tonight then just call your solicitor first thing and see how big a deal it is.

Anyway sorry I've not been able to help but hope all goes well for you tomorrow. Wine and Biscuit

Thanks for the reply MatLeaveForever, he finally turned up 3 1/2 hours late very apologetic and full of explanations.

I have suspect he forgot the appointment until DH called him to be honest but it's done now so I can start to breath!!

Only issue now is the fact I've wasted 4 hours waiting for him when I should have been helping DH unload at the new place so we've got another van load we've got to do before 10am tomorrow Confused
