Can anyone explain what I have to do to evict tenants?

Was really hoping somebody could give me some advice.

We rented out our property a year ago and moved in with family because we couldn't afford the mortgage.

Fortunately we are now in a better position and want to move back into our house.

The 6 month AST ended about 6 months ago.

I think we need to serve a section 21 but really not sure if that right? In fact don't even know what that is and how it should be worded.

Our baby is due in 3 months so really need to get a move on

HELP please!!!

Yeah we told them verbally but they are being a bit difficult, saying they can't move out until summer. Was hoping we could just be relaxed about it but I'm worrying now so thought it would be best to do it formally.

At this stage you are just serving them notice, not actually evicting them (that comes later...)

I'm in Scotland, but this is for England and Wales

What date do you have in mind? What date do they have? 'Summer' is quite vague - you might be worrying about August when they mean May.

Try not to get into a squabble with them though.

Firstly check the signed lease. This should be explicit about how much notice should be given (usually 2 months from landlord), of course this MUST be in writing. If you do end up having problems then you must be able to show that you have handled the situation correctly.
