The exemption which allows you to ask for your child to be excused from religious education and/or religious worship is in Section 71 of the School Standards and Framework Act 1998. However, you shouldn't have to quote this to the school. A simple note saying you don't want your children to attend the carol service should be enough, and would come across as a lot more co-operative than a letter which refers to the law straight away.

Your school should be providing religious education and worship. If you have asked for your child to be excluded for those, they should automatically be excluded from the carol service, although you may want to remind them to make sure.

It is likely that most if not all the other children will go to the carol service. Most parents are happy for their children to go even if they are non-believers (or, indeed, believers in other faiths). Your children may therefore feel left out if they don't go. That does not mean that you are wrong to exclude your children but it is something to bear in mind.
