Primary school appeals

I just have a few concerns.
my son is getting horridly bullied at nursery ( nursery has done nothing about this btw, ofsted is now investigating)

my son is normally so happy bubbly etc, but when this certain kid is around (in or out of nursery) he shuts down completely, we’ve had 3 incidents this last week!
I didn’t get 1st choice primary school so I’ve appealed it in April as concerned for my sons wellbeing and his learning if he went to the same school ( I know the child is going there as his mum has told me and seen them at settling in sessions at the school)
I accepted the choice we got given which is the same one as the child he has had problems with since last year. My sons has attended settling in sessions and likes the school but the child finds him on playground and calls him names etc.

i got the hearing date coming up. If I win the appeal do I have to accept it?
im just worried as I got told to accept the other school and my son has gotten used to the school teachers etc. if I win the appeal he won’t get chance to meet teachers or any settling in sessions. He’ll be going in September with no knowledge of the school and this worries me just as much.

Hope it makes sense. Just a worried mama.

No, you don't have to accept the place if you win the appeal, but the LA may assume that you are going to do so and take away the offer from the allocated school. If that happened, you would need to appeal to get the place reinstated.

However, an appeal on the basis that you think your son will be bullied is unlikely to succeed. The appeal panel is likely to assume that the school has robust anti-bullying policies and will be able to take effective action to prevent any bullying. Also, most appeals for reception are heard under infant class size rules, which means you can only win if a mistake was made. On the information you've posted, I'm afraid it is unlikely you will win your appeal.
