Primary school in year transfer appeal

I'm moving into a new area and have applied for 2 schools which are on our doorstep. I have put in numerous applications but there is no space for my child in year 3 at either school. There is a space for my child in reception. A lot of the other nearby schools have the same situation. There's one school 5 mins away that has space for both but there's no before/after school provision and it's not my preferred option.
I was wondering about accepting a place for my reception child at my first choice school and appealing for my other one. My partners daughter also attends the first choice school. Do you think I'd stand any chance of winning the appeal on the basis her siblings would be going, her 'step' sibling would be there, it's the nearest school and most other schools locally are also full?

That won’t win you an appeal no. If the year is full and they’ve made no admissions error, then appeal only works if you can show the detriment to your child of not going there outweighs the detriment to the school of going overfull. Usually need some pretty special circumstances to win this test.

Do you know where your y3 child would be on the waiting list? She may already be counted as a sibling due to stepsister (depending on their sibling definition) and if not then she’ll be a sibling as soon as your reception age child starts. Being a sibling should push her top of the waiting list.

Unfortunately rhsy don't have waiting lists, it's a case of constantly re applying until there's a place avaliable which is a crazy system. It feels almost impossible to get 2 spaces at tue sane time.
