Infant school appeal

Hi, this is going to be a long one, appreciate any help.

2 children struggling at school, especially youngest in Year 2. Bullying, teachers off long term sick, could go on.

In November I Identified a great school and decided in year admission will be best. Applied to council to move, told takes up to 15 working days to process.

Waited patiently (big mistake). Working day 10 I phone up. Eldest given a place in Year 5. No spaces for Year 2. Start Year 5 a week later in December. Over several phone calls was told Year 2 child was 1st on waiting list then 2nd then 1st, couldn’t get a definite answer on phone and a different answer from everyone I spoke to.

Council didn’t let me know in writing that my son did not have a space until 18 working days when it says they must do it within 15 days. Is this reasonable grounds for appeal as they were late?

Back to school this week and two new joiners start Year 2. I ask council how this happened. One child applied before us. The other accepted before my eldest’s 1st day, and until he was physically in the school on his first day my youngest did not get sibling priority. None of which was ever communicated to me. No more spaces.

Had I known this I would have been on to the council every day and had my eldest at school even earlier to bump my youngest up the list.

Council say have acted within the law in offering g spaces but feel they have been unfair in not being transparent. And they sent email saying he didn’t have a space late.

Infant appeals are tricky with the law on numbers but will this help my appeal?

My youngest is distressed and has been referred for counselling because of his behaviour as a direct result of what he is going through at current school but that could take forever. Current school said possible signs of autism or ADHD but can’t refer until he’s at least 7. Won’t put any reasonable adjustments in place to help him. I am worried sick and feel stranded.

He is even lower on waiting list for other schools.

If I fail appeal because infant class restriction with numbers when can I appeal again?
