Hi my daughter hasn't got in any of my 3 choices. She has special educational needs without a statement in place. She currently attends the nursery in the school that was my first choice. Has anyone successfully appealed on the this basis. The school she is in are brilliant with her needs and she has made so much progress while there and finally started to interact with other children and make friends. I really feel that moving her from this school will be detrimental to her development in all areas. Any words of advice welcome. Thanks

The first thing you need to determine is whether it is an infant class size appeal (are children taught in 30 per class in years r, 1or 2).

If so, then you would need to prove an error had been made that cost you a place, or that the decision not to give a place was so unreasonable a normal person would not have made it. These are very very hard to win.

If it is not ICS then you need to show that the detriment to your child of not attending is greater than the detriment to the school of admitting another pupil. This is also usually a high bar, and would need you to show strong reasons that this school meets her specific needs.

I know the class is full and she is on the waiting list but her not getting in the school will impact her development and progress. So want to do everything I can to make sure my daughter has the right education and support to help her to continue to progress

I'm no expert but I would say kick off a request for an EHCP even if you are not convinced she'll get one, and even if it takes too long to get her in by 1st Sept.

Hi I've started ehcp process today online. She's number 2 on the waiting list for the school she's at so far. The school they are placing her in for September has a bad Ofsted report and states that lessons aren't planned properly and lower attaining pupils are affected. If she ends up in that school if I fail with the appeal it is going to affect her massively.
