Infant Class Size Rules Question

My children go to a very small village school - we partyl chose it because of its size and small class sizes. In the time we’ve been there new estates near us have led to lots of in year admissions and all classes are now nearly at capacity.

One of mine is in a mixed Key Stage class of year 2, 3 and 4 children that due to recent additions will have 32 children in. Is this allowed under Infant Class Size rules? How does the leislation work in mixed key stage groups?

2 things spring to mind. Firstly Years 3 and 4 are not subject to the infant class size regulations anyway and secondly, 2 children may be 'excepted children' which mean the school have to take them and ICS regs do not matter.

We have31 in one class as we have identical twins in the school year.

Thank you. I don’t think hon they’re excepted from what I know (but of course it’s none of my business!) but from reading it seems that the ICS regs don’t apply as the majority in the class are KS2. This seems a real shame for my summer born year 2 :(

You can go above 30 for various reasons such as twins being admissions 30 and 31 or successful appeals or fair access protocol.

There are 32 in my ds's y1 class (he is no32) and 31 in reception.

The answer is that if the majority of the class is year 2, then the class will be subject to the infant class size regs, but if the majority is in year 3 and 4 then it will not be an infant class size regs class.
As others have said even if the majority are year 2, the 2 extra might be there for perfectly legitimate reasons and therefore not counted as infant class size. Having said that having a class of 32 with three age groups is going to be hard work for a teacher in differentiating across what could nearly 5 years in pupil ages.

It's 30 per class per teacher, so essentially they can have all those three years together mixed and as long as there is more than one teacher if over 30, or are classed as exempted pupils due to twins or appeals admissions then yes is allowed and they arent breaking rules x

As admission says if the majority of children are Y3 and Y4 (and I'm assuming this is likely the case) then infant class size rules don't apply.

That seems like a ridiculously difficult job for the teacher. I wouldn't even know where to begin.

I know Kangar- it’s a real shame and as my yr 2 child is not 7 until the summer holidays and is with children who maybe nearly 10! She is a lovely teacher though but it would be a lot better if they could make the class smaller - there’s no money for another classroom or teacher though.
