Hi

I have one last query re my forthcoming appeal and would also just like to say a HUGE thank you to everyone who has offered me advice when I ve asked. In all honesty I dont expect to win but I have to give it my best shot for my daughters happiness and health.

I had already submitted my evidence when I requested an appeal. I have received the refusal statement from the LA and is appears to be a fairly standard one.

I do have a few additional pieces of evidence for the stage 2 appeal to send in but I just wondered do I need to send my list of questions which I will ask on the day in relation to the LA refusal statement - e.g over crowding - so have there been any incidents reported to Riddor, what effect on education has being above PAN previously had etc ??

They mention staffing / funding yet the website and the LA statement indicates there is sufficient staffing - do I sent the print out from the website indicating this or do I simply just mention it and have it to hand in case Im asked?

Sorry for the simple questions I just want to get it right. Also I have an audio clip of my daughter getting very distressed about school which forms a large part of our case (bullying, anxiety etc) - should I play this at the appeal or try to send in advance.

No, you don't need to submit your questions. You can ask them on the day.

Personally I would see what they say in the hearing about staffing/funding. If they make a big thing of it you can challenge it with what the LA has said and any useful information on their website. Personally I would do that by questioning them rather than including it in your statement.

I would strongly advise against using the audio clip. That may produce a very negative reaction from the appeal panel. Stick to documentary evidence.

Good luck, OP. I did not comment on your other thread as I have no advice but I have won three appeals for my DC (don't know how!) so there is hope.

Do not use the clip of your daughter, it usually is not a good idea to make it personal with the panel.
By all means take it with you and in describing the anxiety mention that you do have a clip but that you did not think it was appropriate to play it. If the panel want it played they will ask but most would not want to have it played.
